Enclosed is the agreement between Diamond View Developments Inc and The Occupant. Please read the agreement carefully prior to signing.

THIS SHORT TERM RENTAL AGREEMENT herein after referred to as "Occupancy Agreement", made between Diamond View Developments Inc. hereinafter referred to as "Agent", and The Occupant of the premises hereinafter referred to as the "Occupant". The Agent grants to The Occupant pursuant to all provincial laws, and the Policies attached here to as Schedule "A" (the "Policies") the right to occupy the vacation residence described below in its present condition, under the terms herein stated: In the event the Occupant does not accept this agreement within 24 hrs. This Occupancy Agreement and the rental period will be cancelled. The Occupant offers to rent from the Agent the premises commonly known as Cottages at the Diamond, Address: Old Parry Sound Rd, Utterson Ontario, P0B 1MO and identified in the Reservation Confirmation (the "Premises") upon the following terms and conditions. 1. TERM: The term will commence on your "Check in Arrival Date" and continue until your "Check out Departure Date", as confirmed on the Reservation Confirmation. 2. USE: The Premises will be used exclusively as a cottage for no more than 6 occupants. Infants under the age of 2 are exempt. Hogan Cottage - Maximum occupancy is 8 adults + two. An additional charge of $179.00 per night will be added to all Hogan Cottage bookings. 3. ASSIGNMENT AND SUBLETTING: The Occupant will not assign this Agreement or sublet any portion of the Premises without prior written consent of the Agent, which may be arbitrarily withheld. 4. MAINTENANCE AND DAMAGE: The Occupant acknowledges that, unless the Agent is notified immediately upon occupancy, the Premises, including the furniture, fixtures and appliances shall be deemed to be in good working order and repair. In the event that the Occupant notices damages to the Premises, or any inoperable equipment or appliances, upon arrival, they are to notify the Agent immediately. The Occupant will surrender the Premises, at specified check out time on the Check-Out Departure Date, in the same condition as received. All dishes used must be washed by the Occupant prior to check out. If the Premises require, extra cleaning because it has been left it in poor condition, the Occupant will be charged an additional cleaning fee. The Occupant will be responsible for any damage caused by themselves or their family, invitees, and/or guests to the Premises, the Common Equipment or the Resort. The Occupant will not leave any waste upon the Premises or anywhere in the Common Areas (defined in the Polices). It is understood that Agent's insurance does not cover The Occupant's personal property. 5. ENTRY AND INSPECTION: Agent will have the right to enter the Premises: (a) In case of emergency; (b) To make necessary or agreed repairs, decorations, alterations, improvements, supply necessary or agreed services, show the Premises to contractors. 6. LIABILITIES: The Occupant agrees that the Agent, its officers, directors, and employees including the resort manager, shall not be liable or responsible for: a) The death or personal injury, however caused that may be suffered or sustained by the Occupant, or the Occupant's guests; b) Any loss, damage or injury however caused without limitation loss due to theft, fire, vandalism, robbery or Acts of God, to any property of the Occupants or the Occupant's guest; and c) Any loss, damage, or inconvenience caused to the Occupant by reason of the lack of availability of any facilities, including the Premises, or any portion of the Resort, the Common Areas, or the Common Equipment. The Occupant shall indemnify and save harmless the Agent, its officers, directors, and employees including the resort manager from any and all claims, demands, liabilities, losses, damages and injuries of whatsoever kind and nature, and all costs and expenses including, but not limited to legal fees, arising from or incidental to the use of the Premises, the Resort, the Common Areas, or the Common Equipment by the Occupant, and the Occupant's guests. 7. FAILURE TO FOLLOW POLICIES/TERMINATION OF THIS OCCUPANCY AGREEMENT: In the event of any material breach of the Policies or breach of this Occupancy Agreement by the Occupant or the Occupant's guests, the Occupant agrees that Agent shall have the right to cancel and terminate this Occupancy Agreement and that immediately upon such termination, the Agent may forthwith take possession of the Premises, and remove the Occupant, the Occupant's guests and all of their property from the Premises and neither the Agent, its officers, directors, and employees including the resort manager shall be liable in damages or otherwise by reason of such termination and removal, and notwithstanding such termination and removal, the Occupant shall remain liable for payment of all sums due pursuant to this Occupancy Agreement.
